  1. Eligibility:  
    1. The skill-based Contest is open to legal residents of the following countries who are at least 18 years old, or the age of majority in the jurisdiction where they reside, whichever is older: Argentina, Austria, Belgium, Canada (excluding Quebec), France, India, Ireland, Japan, the Netherlands, New Zealand, Singapore, South Africa, South Korea, Spain, Switzerland, the United Kingdom, and the United States.
    2. The following people, however, are not eligible to enter. Individuals who: (i) are, or at any point since December 1, 2018 have been, employees, contractors, directors, officers, or agents salesforce.com, inc. (“Organizer”) or any of its direct or indirect wholly or majority owned subsidiaries; (ii) are the immediate family (spouse, parents, siblings, and children) or household members of any of those employees or former employees in (i) above; (iii) are current employees of an entity in which salesforce.com has invested and holds an ownership interest; or (iv) are employees of any government agency.
    3. If you are an employee of a company or an academic institution, you are responsible for ensuring that your participation in the Contest complies with any policies your company, agency, or institution may have regarding participation in contests of this type. We are not responsible for any disputes arising between you and your employer.
  2. Entry Period:  The Entry Period begins at 12:00 AM PT on May 24, 2019 and ends at 11:59 PM PT on June 10, 2019. Organizer’s clock will be the official timekeeping device for the Contest.
  3. How to Enter:  During the Entry Period, visit info.datorama.com/app-contest and complete the entry form.
    1. You can enter as a team, as long as each member of the team meets the eligibility criteria above. If you do enter as a team, you must provide contact information for each team member and designate a Team Leader. Organizer will communicate solely with the Team Leader. After you register, you will not be allowed to switch teams, or add or remove team members. Organizer is not responsible for, and will not assist in resolving, any disputes between team members. There is a limit of five (5) entries per person during the Entry Period, regardless of whether entering individually or as part of a team.
    2. Among other things, you will be required to submit information about your app and supporting documentation. Everything you submit on the entry form will constitute part of your Entry. Please make sure your Entry does not: (i) violate anyone’s rights, including, but not limited to, copyrights or trademark rights; (ii) prominently feature any third-party trademarks or logos; (iii) portray Organizer or its services in a negative light; or (iv) contain any content that is inappropriate or indecent, as determined by Organizer, in its sole discretion. All materials must be in English.
    3. By entering, you represent and warrant that: (i) the Entry is an original work; (ii) you own all rights to the Entry; and (iii) your Entry does not violate any third party’s rights. By entering, you also indicate your full agreement to these Official Rules and Organizer’s decisions regarding the Contest, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.
  4. Judging and Notification:  
    1. After the Entry Period, a panel of judges will select five (5) potential winners based on the following Judging Criteria: (a) Does it solve a real problem and/or create instant value? (25%); (b) is it based on a common use case and are the data sources widely used in the platform? (20%); (c) Is it well designed and executed? (20%); (d) Does the app introduce a new capability / enhance platform capabilities in a meaningful way? (25%); and (e) Additional supporting materials and documentation (10%).
    2. Organizer will then attempt to contact the five (5) potential winners (or Team Leaders) on or about July 1, 2019. If a potential winner doesn’t respond within seven (7) days of the time the notice is sent, Organizer may select an alternate potential winner in his/her place according to the Judging Criteria.
    3. You are not a winner until you receive an official e-mail confirmation from Organizer confirming your status.
  5. Potential Winner Requirements:  Except where prohibited, the potential winner (including each member of a team) may be required to complete and return a declaration of eligibility, a transfer of rights to the Entry, and a liability/publicity release. If a potential winner (or any member of a team) fails to sign and return these documents within the period of time specified by Organizer, Organizer may select an alternate potential winner in his/her place according to the Judging Criteria, if time permits. No more than three (3) alternates will be contacted.
  6. Prizes:  
    1. One (1) first place winner will received $25,000 USD, one (1) second place winner will receive $10,000 USD, one (1) third place winner will receive $7,000 USD, one (1) fourth place winner will receive $5,000 USD, and one (1) fifth place winner will receive $3,000 USD. Prizes will be sent approximately 120 days after winner verification. If a winner is a team, Organizer in its sole discretion may pay the prize to the Team Leader, who will be responsible for distributing the prize to other team members. If Organizer pays the prize to individual team members, the prize will be divided into equal amounts based on the number of email addresses submitted to Organizer by Team Leader in the entry form.
    2. Each member of the winning teams will be required to sign an Affidavit of Eligibility and a Liability and Publicity Release, and if applicable a W-9 tax form (for U.S. residents) or W-8BEN tax form (for non-U.S. residents) in order to receive a prize. For purposes of such tax forms, Organizer will assume that each member of a team will receive an equal share of the prize, unless the Team Leader informs Organizer in writing otherwise. If you do not sign the required forms or provide the required information within thirty (30) days following our request we may disqualify you from receiving a prize. Taxes shall be the sole responsibility of each winning team member.
    3. Any prize details not specified above will be determined by Organizer, in its sole discretion. A prize may not be transferred and must be accepted as awarded. The Winner is also responsible for paying any taxes, costs, and expenses not listed above.
  7. How Your Entry May be Used:  
    1. You do not transfer ownership of your Entry (or any part of it) by submitting it. However, by submitting an Entry, you grant Organizer an irrevocable, royalty-free, worldwide rights and license to: (a) use, review, assess, test, and otherwise analyze your Entry and all its content in connection with the Contest; and (b) feature your Entry and all its content for promotional purposes (including, but not limited to, in advertisements, press releases, presentations, and trade shows) in all media, now known or later developed. You also agree to sign any necessary documentation that may be required for us and our designees to make use of the rights you granted.
    2. You acknowledge that Organizer, other entrants, or others may have developed or commissioned materials similar or identical to your Entry, or may develop something similar in the future, and you waive any claims you may have resulting from any similarities to your Entry.
    3. You understand that Organizer cannot control the information you disclose to us or our representatives in the course of participating in the Contest, or what we or our representatives will remember about your Entry. You also understand that Organizer will not restrict work assignments of representatives who have had access to your Entry. By participating in the Contest, you agree that Organizer may use any information in our representatives’ unaided memories in the development or deployment of our products or services without liability or compensation to you. You understand that you will not receive any compensation or credit from us for use of your Entry in connection with this Contest. Organizer is not responsible for any unauthorized use of your Entry by those accessing or viewing your Entry.
    4. If you do not want to grant us these rights to your Entry, please do not enter this Contest.
  8. General Conditions:  In the event that the operation, security, or administration of the Contest is impaired in any way, Organizer may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Organizer reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Organizer’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Organizer by mail shall not be deemed proof of receipt of that communication by Organizer. The Contest is subject to federal, provincial, state, and local laws and regulations and is void where prohibited.
  9. Release and Limitations of Liability:  Except where prohibited by law, in cases of death or personal injury caused by our negligence, or fraud or breach by us of these Official Rules, you agree to release and hold harmless Organizer, its officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors that may impair your ability to participate in the Contest; (c) errors in the administration of the Contest arising from circumstances beyond Organizer’s reasonable control; (c) any claim or allegation that your Entry infringes any copyright, trademark, or any other intellectual property right; (e) disputes between team members; (f) disputes between team members and their employer; and (g) claims relating to injuries, death, or damage to persons or property relating in any way to your participation in the Contest or use of a prize.
  10. Privacy and Publicity:  Any information you submit as part of the Contest will be used for purposes of this Contest and treated in accordance with Organizer’s Privacy Statement. Except where prohibited, participation in the Contest constitutes your consent to our use of your name, likeness, voice, opinions, biographical information, and jurisdiction of residence for promotional purposes in any media without further payment or consideration, and to the cross-border transfer of such information, consistent with applicable law.
  11. Disputes:  Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in San Francisco, CA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, our rights and obligations connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.
  12. Winner Information:  Winners will be posted on Datorama’s Always On blog.
